Terms of Service

1. Acceptance of Terms
Vela ("Vela," "we," "us," or "our") is operated by an individual developer, not a registered company. By adding Vela to a Discord server, using any of its commands, or accessing the Vela web dashboard at velabot.xyz (together, the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not add Vela to a server, and discontinue use of the dashboard immediately.
These Terms apply to everyone who interacts with Vela — server owners, administrators, staff, and individual members of any server Vela has been added to, as well as anyone using the dashboard.

2. Description of Service
Vela is a Discord bot and companion web dashboard providing server-management features including, but not limited to:
- Automated moderation — spam/toxicity detection ("heat system"), word filters, and an optional AI-assisted analysis feature (see Section 8)
- XP, leveling, and customizable rank cards
- Ticket and support-panel management, including saved conversation transcripts
- Giveaway hosting and entry tracking
- Custom tags/commands configurable by server staff
- Server activity logging (joins, leaves, message edits, bans, and similar events)
- Invite tracking
- Embed broadcasting and welcome-message configuration
- A rank-card report/appeal system for cross-server content moderation
3. Eligibility
You must be at least 13 years of age — or the minimum age required to use Discord in your country, if higher — to use Vela, consistent with Discord's own Terms of Service. By using Vela, you represent that you meet this requirement.
You must also comply with Discord's Terms of Service and Community Guidelines at all times while using the Service. Nothing in these Terms overrides or limits Discord's own terms — if the two conflict, Discord's terms control your use of the Discord platform itself.

4. Server Owner Authority & Consent
If you add Vela to a Discord server, you represent that you have the authority under Discord's platform (as the server owner or an administrator with permission to add bots) to do so, and that you have the authority to permit Vela to collect and process the server-visible data described in our Privacy Policy for the members of that server, for the purpose of providing the Service to that server.
Individual members of a server do not separately sign these Terms — by participating in a server that uses Vela, they are subject to the moderation, logging, and feature behavior the server's admins have configured, the same as with any other bot or moderation tool on that server.

5. Permitted Use
You may use Vela solely for its intended purpose of managing and enhancing a Discord server that you own or have administrator/staff permission in. You are responsible for ensuring your use of Vela — and your configuration of it — complies with all applicable laws and with Discord's own policies.
6. Prohibited Use
You agree not to use Vela to:
- Harass, threaten, abuse, or harm any person or group
- Distribute illegal content, spam, or unsolicited messages
- Attempt to bypass, exploit, disrupt, or reverse-engineer the bot, the dashboard, or their underlying infrastructure
- Automate interactions with the bot in ways not intended by its design, including scripted abuse of rate limits or the API
- Use moderation features to unfairly target or discriminate against users on the basis of race, gender, religion, sexuality, disability, or other protected characteristics
- Impersonate Vela, its developer, or misrepresent your affiliation with the Service
- Upload or configure content (rank-card images, embeds, tags, welcome messages) that is illegal, infringing, or violates Discord's Community Guidelines
- Use the Service in any way that violates Discord's Terms of Service or Community Guidelines
7. Server Owner & Staff Responsibility
The person who adds Vela to a server, and the staff that server owner appoints, are solely responsible for how Vela is configured and used within that server — including moderation thresholds, welcome messages, logging configuration, ticket panels, and access to any transcripts or reports that configuration exposes to them.
Vela's developer is not responsible for disciplinary actions your server's staff take using Vela, for decisions your staff make after reviewing a ticket transcript or moderation log, or for how your staff configure automated features. If your server enables a feature that logs or stores message content (Section 8 and our Privacy Policy explain exactly which features do this), you are responsible for making sure your members are aware, to the extent required by law in your jurisdiction.

8. AI-Assisted Features
Vela offers an optional, off-by-default AI-assisted moderation feature that sends message text to a third-party AI provider (Groq) for automated classification when enabled by a server admin. It also includes a
AI-generated output — moderation verdicts included — can be wrong. Automated moderation decisions, whether AI-assisted or not, are provided as a tool for human moderators, not a substitute for human judgment, and we make no guarantee of their accuracy. See Section 11 (Disclaimer of Warranties).

9. User-Generated Content License
When you upload or configure content through Vela — rank-card background images, custom tags, embed templates, welcome messages, and similar — you retain ownership of that content. You grant us a limited, non-exclusive, royalty-free license to store, reproduce, and display that content solely as necessary to operate the Service (for example, rendering your rank card, or posting your configured welcome message).
You represent that you have the right to upload whatever content you configure, and that it does not infringe any third party's rights. We reserve the right to remove any user-generated content that violates these Terms, without notice.

10. Intellectual Property
All software, designs, graphics, and content associated with Vela — including the bot, the dashboard at velabot.xyz, and all associated branding — are the intellectual property of Vela's developer, except for user-generated content covered by Section 9. Nothing in these Terms grants you any ownership, license, or rights to that property beyond what is necessary to use the Service as intended.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available," without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components, and we make no guarantee about uptime, feature availability, or the accuracy of any automated moderation decision (AI-assisted or otherwise).
You use Vela, and rely on any moderation action it takes, at your own risk. We strongly recommend that server staff review significant moderation actions rather than relying on automation alone.

12. Limitation of Liability
To the fullest extent permitted by applicable law, Vela's developer will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of the Service — including but not limited to lost data, incorrect or unfair moderation actions, missed events, server disruptions, or reputational harm — even if advised of the possibility of such damages.
To the fullest extent permitted by applicable law, our total aggregate liability to you for any and all claims arising under these Terms will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) fifty US dollars ($50). As Vela is currently free to use, the amount under (a) is zero.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you in full.

13. Indemnification
You agree to defend, indemnify, and hold harmless Vela's developer from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with: your use of the Service; your violation of these Terms; your violation of any third party's rights, including any rights of your server's members; or content you configured through the Service.

We reserve the right to remove Vela from any server, suspend or revoke dashboard access, or otherwise terminate your access to the Service at any time, for any reason or no reason, including for violation of these Terms, with or without notice.
You may stop using Vela at any time by removing the bot from your server and discontinuing use of the dashboard. Upon removal, your data is retained per our Privacy Policy but is no longer actively used, and you may request deletion at any time.

15. Changes to These Terms
We may update these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. If a change is material, we will post a notice in the Vela support server in advance where practical. Continued use of Vela after changes take effect constitutes acceptance of the revised Terms; if you do not agree to a change, your only remedy is to stop using the Service.
16. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law provisions. Any dispute arising under these Terms that cannot be resolved informally will be brought exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary so that these Terms otherwise remain in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Vela's developer regarding the Service, and supersede any prior agreements. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
